When getting into the business of buying and selling firearms, there are many federal and state requirements to be met. Not only does a local or state government control certain transactions involving firearms, but the federal government also has its own requirements. Many if not most of these federal firearms requirements stem from the Gun Control Act of 1968 which, among other things, established the federal firearms license (FFL) as we know it.

Under the Gun Control Act of 1968 (GCA), the number one reason for denial is to be listed as "prohibited person". Being listed as a prohibited person means that you will not meet the federal firearms requirements necessary to deal in firearms. Below listed are examples of what a "prohibited person" is under the GCA, and some simple explanations.

1. If you've been convicted in a federal court of a crime with an imprisonment of more than a year, or if you've been convicted in a state court of a crime which carries more than two years' imprisonment, then you are a "prohibited person." If the case is, however, involves regulation of businesses practices, you would not be considered prohibited.

2. If you're a fugitive from justice.

3. If you're addicted to any sort of drug or controlled substance.

4. If you've been adjudicated as mentally defective or committed to a mental institution.

5. If you're an alien under a non-immigrant visa. Immigrants with visas can have guns so long as they have a valid hunting license.

6. If you've been discharged dishonorably from the military or any branch of the armed services.

7. If you've renounced your citizenship to the United States of America.

8. If you've ever been under a restraining order from harassing, stalking, or threatening an "domestic partner" of a child of that partner.

9. If you've ever been convicted of a misdemeanor crime of domestic violence.

Other federal firearms requirements include the Brady Handgun Violence Prevention Act (1993) that created a national background check system to prevent sales to prohibited persons. All of these federal firearms requirements are important, because if you fall under the categories of anything that would define you as a prohibited person, then you would not be able to hold an FFL.

Careful consideration and a better understanding of both the Gun Control Act of 1968 and The Brady Handgun Violence Protection Act (1993) will help you in your personal Federal Firearms Licensing process.
